§ 1 Scope, provider, contract languages

(1) These Terms of Use ("Terms") apply to the use of the "Pickeroni" app for iOS and Android ("Pickeroni"). They govern the contract between you and us.

(2) The provider of Pickeroni and your contracting party is:

Felix Pieschka
Steglitzer Damm 34
12169 Berlin
Germany
Email: contact@pickeroni.com
Phone: +49 30 20917078

("we", "us"). Further details are in our legal notice at pickeroni.com/impressum.

(3) We offer Pickeroni only in the member states of the European Union and in Iceland, Liechtenstein and Norway. Pickeroni is intended for private use.

(4) The contract languages are German and English. The German and the English version of these Terms have the same content. If they nevertheless differ, the version more favourable to you applies.

(5) You can access, save and print the current version of these Terms at any time at pickeroni.com/terms and in the app under Account › Legal. We store which version you agreed to and when, and we keep the text of every version. We will send you an earlier version on request.

(6) You download Pickeroni from Apple's App Store or from Google Play. The terms of the respective store also apply to the download and to purchases. Apple and Google are not parties to the contract between you and us. For the iOS app, these Terms replace Apple's standard Licensed Application End User License Agreement; § 18 also applies.

§ 2 What Pickeroni offers

(1) Pickeroni is a recipe app for groups such as families, flatmates or friends. With Pickeroni you can:

  • create your own recipes – with a photo, ingredients and quantities, preparation steps, categories and, if you like, a link to another website;
  • convert quantities with the serving calculator and cook in cooking mode with timers;
  • create shared lists and invite others by link or code (§ 9);
  • vote on recipes in a list; a poll has an end date and then closes automatically;
  • create meal plans and turn them into shopping lists; Pickeroni calculates the quantities and sorts the shopping list by supermarket aisle, and you can correct the sorting;
  • save editorially selected "Recipes from Pickeroni" as your own copy (§ 17);
  • receive push notifications, for example when a poll starts, is about to end or has ended (§ 9 (7)).

(2) Pickeroni is not a recipe database, does not import recipes from websites, is not a social network and is not a web app. Your content is not public: only you and the members of the lists you assign it to can see it (§ 9).

(3) To use Pickeroni you need an account (§ 3), a device running iOS or Android and an internet connection. The supported versions of iOS and Android are shown in the respective store.

(4) Pickeroni is free to use within the free limits (§ 5) and the usage limits (§ 6). A one-time purchase removes the free limits for your account (§ 7). There is no subscription.

(5) Pickeroni is a digital product. The statutory rules on contracts for digital products (sections 327 et seq. of the German Civil Code, BGB) also apply to your contract with us if you do not pay anything: you provide us with personal data, and we process it not only to provide Pickeroni but also, for example, for usage statistics. Details are in the Privacy Policy.

§ 3 Conclusion of the contract, account and minimum age

(1) Registration with an email address: under "Register" you enter your name, your email address and a password; your year of birth is optional. You then tick the box "I am at least 16 years old, accept the Terms of Service and have read the Privacy Policy." and submit the registration. Until then you can check and change all entries. We send you an email with a confirmation link that is valid for 60 minutes; after that you can request a new confirmation email in the app. The contract is concluded when you confirm your email address via the link. Only then can you use your account.

(2) Sign-in with Apple or Google: if there is no Pickeroni account yet for your Apple or Google account, the app asks for your agreement with the same box. The contract is concluded as soon as you have agreed and the account has been created. Such an account is not automatically linked to an account you created with the same email address and a password.

(3) There is at most one account per email address. Provide truthful information when registering, keep your password secret and do not let anyone else use your account. If you suspect that someone is misusing your account, change your password and let us know. Under Account › Active sessions you can see on which devices you are signed in and sign them out.

(4) You must be at least 16 years old. If you are under 18, you need the consent of your parents or other legal guardians for this contract, because it also places obligations on you, for example under § 8 and § 10. By registering, you confirm that this consent has been given. We do not check your age technically.

(5) If you are under 16 or your parents refuse their consent, you may not use Pickeroni. If we learn of this, we will end the contract and delete your account; we will let you know beforehand.

(6) You conclude purchases (§ 7) with Apple or Google. Whether you can make a valid purchase as a minor without your parents' consent depends on the law (sections 106 et seq. BGB) and the store's terms.

§ 4 Right of withdrawal from the free user agreement

(1) This section applies only to the free user agreement with us (§ 3). It does not apply to the purchase of the unlock: you make the purchase with Apple or Google, and your right of withdrawal for the purchase is governed by their withdrawal information and terms (§ 7 (6)).

(2) For the free user agreement, the following applies:

Information on the right of withdrawal

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us (Felix Pieschka, Steglitzer Damm 34, 12169 Berlin, Germany, phone: +49 30 20917078, email: contact@pickeroni.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but this is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we will end it and delete your account; § 15 (5) applies. You have not made any payments to us, and the withdrawal does not cost you anything.

End of the information on the right of withdrawal

(3) A purchase of the unlock from the store is not affected by a withdrawal under (2); you can assign the unlock to a new account (§ 7 (5)).

§ 5 Free use and free limits

(1) Without a purchase you can use all features of Pickeroni, but some only in limited quantities ("free limits"):

WhatFree limit without a purchase
Your own recipes10 – this includes recipes you saved from a list or from the "Recipes from Pickeroni"
of which saved "Recipes from Pickeroni"at most 5 at a time; they count towards the 10 own recipes
Your own lists (lists you are the owner of)1
Creating meal plans5 in total; deleting a meal plan does not free up a slot
Adding items to a shopping list by handnot possible

Example: if you have saved 5 Recipes from Pickeroni, you can still create 5 recipes of your own without a purchase.

(2) Without a purchase and without a free limit – that is, only within the usage limits (§ 6) – you can join other people's lists and view their content, vote, start polls, mark recipes in meal plans as "cooked", tick off items on shopping lists and fill shopping lists with recipes.

(3) Your free limits apply to your account, including in other people's lists. If you create a meal plan in someone else's list, it counts towards your 5 meal plans. You can add items by hand only with your own unlock, even in the list of a person who has bought the unlock. Another person's purchase does not remove your free limits (§ 7 (4)).

(4) When you reach a free limit, the app shows a notice. Everything you have already saved is kept; you can still view and edit it.

§ 6 Usage limits

(1) To prevent abuse, the following fixed maximums ("usage limits") apply to all accounts – with and without a purchase, including accounts with the unlock ("Premium"). The unlock only removes the free limits under § 5, not the usage limits.

WhatUsage limit
Your own recipes (including saved recipes)500
Your own recipes with a photo you uploaded500
Your own lists100
List memberships (your own and other people's lists combined)500
People per list (owner and members combined)50
Polls per list500
Meal plans500 per list and 500 personal
Shopping lists500 per list and 500 personal
Items per shopping list300
Devices receiving push notifications20; if you register another device, the oldest device registration is removed
Remembered corrections of the aisle sorting500 per list and 500 for your personal shopping lists; after that, each new correction replaces the oldest

(2) When you reach a usage limit, you cannot create anything new at that point, and the app shows a notice; for devices and corrections the rule in the table applies instead. Existing content is kept.

(3) Wherever we refer to usage limits with an asterisk (*) in the app, on our website or in the store, this means the values in (1).

(4) If we lower a usage limit, this is a change under § 13 – also for accounts with the unlock.

§ 7 Unlock (in-app purchase)

(1) You can buy the unlock in the app. It comes in two variants with the same features: "One-time purchase" and, at a higher price, "Support us". With the higher variant you support the further development of Pickeroni; it does not give you any further features. The unlock is a one-time purchase, not a subscription.

(2) The unlock removes the free limits under § 5 for your account for as long as the user agreement exists. The usage limits under § 6 continue to apply. In the app, an account with the unlock is called "Premium".

(3) Purchase and payment are handled exclusively via the App Store or Google Play. You do not conclude the purchase contract with us but, in the App Store, with Apple and, on Google Play, with Google Commerce Limited. You see the price in the app and in the store before buying; it includes statutory VAT. We do not receive your payment details.

(4) The unlock applies to the Pickeroni account with which you bought or restored it. Using "Restore purchases" you can assign it to this account again, for example on a new device. A purchase only ever belongs to one Pickeroni account. Your unlock does not apply to other members of your lists.

(5) If you delete your account, we also delete the record of your purchase. You can then assign the unlock to a new Pickeroni account with the same store account via "Restore purchases", as long as the purchase is still valid with the store, i.e. has not been refunded. A purchase only ever applies to one account.

(6) Withdrawal from the purchase and refunds are governed by the terms and the withdrawal information of the respective store; please contact Apple or Google for this.

(7) If the store refunds the purchase price to you, the unlock ends and the free limits under § 5 apply again. Everything you have already saved is kept; you can still view and edit it.

(8) We provide the unlock itself – i.e. the removal of the free limits for your account – under the user agreement. If it does not work as described, you have the statutory rights for defects in digital products against us (§ 12 (4)); your rights against the store under the purchase contract remain unaffected.

§ 8 Your content

(1) Recipes, photos, texts and links that you add to Pickeroni ("your content") remain yours. You keep all rights to them.

(2) So that we can operate Pickeroni, you grant us the simple (non-exclusive), free and non-transferable right to

  1. a) store your content, including in backup copies,
  2. b) convert it technically, in particular to re-encode photos and create smaller preview images,
  3. c) display it to the members of the lists you assign it to, and
  4. d) mention the names of recipes and lists and your display name in push notifications to these members.

We may use technical service providers for this, for example to send push notifications. This right applies for as long as the content is stored in Pickeroni, and in backup copies until they are deleted as described in the Privacy Policy. We do not receive any further rights to your content; in particular, we do not publish it and do not use it for advertising.

(3) When you share a recipe with a list, the members of this list may see it and save a copy, including the photo, to their own account ("Save recipe"). They may use this copy privately, edit it and share it with their own lists – even after you have left the list or deleted your recipe. For this purpose you grant each member the simple (non-exclusive), free and non-transferable right to reproduce your recipe including the photo, to edit it and to make it available to the members of their lists; these members receive the same rights to the copy. Polls in the list keep the name and photo of your recipe until the list is deleted; meal plans and shopping lists keep its name until they themselves or the list are deleted. You also grant the rights needed for this. This does not permit any public or commercial use. The app points this out to you the first time you share a recipe with a list.

(4) If we block a recipe after a report (§ 11), we may also block the copies that members have saved from it. The rights under (3) to a copy exist only as long as it is not blocked. Polls, meal plans and shopping lists show a blocked recipe or a blocked copy neither with its name nor with its photo.

(5) Only upload recipes, texts and photos for which you have the necessary rights – usually because you created them yourself. Photos from the internet, cookbooks or magazines are almost always protected and must not be uploaded without permission. If a photo shows identifiable people, you need their consent. Content that violates the law or the rights of others is prohibited (§ 10). If you culpably breach these obligations, you shall indemnify us against justified claims by third parties, including reasonable costs of legal defence.

(6) Links in recipes are added by users. We do not check the linked pages and do not adopt their content as our own. You can report unlawful links via "Report recipe" (§ 11).

(7) We do not check your content before others see it. If unlawful content is reported to us, we act in accordance with § 11.

§ 9 Shared lists

(1) Whoever creates a list is its owner. Others join a list via an invite link or an invite code. Every member can pass on the list's link or code; only the owner can renew or revoke it and remove members from the list. Members can leave the list at any time ("Leave list").

(2) An invite link is valid for 7 days, an invite code for 90 minutes. There is at most one valid link and one valid code per list. Anyone who knows the link or code can join the list during this time – so only pass it on to people you want in the list. Anyone who opens the link sees the name of the list and the display name of the inviting person, even without an account.

(3) All members of a list see the list's recipes, polls, meal plans and shopping lists and the display names of the other members. Personal meal plans and shopping lists are only visible to the person who created them.

(4) Polls are not secret: members see by name who voted for which recipe, even while the poll is running.

(5) If you delete your account and you are the owner of a list with other members, the list and its content pass automatically and without asking to the member who has belonged to it the longest; your own recipes are deleted. If the list has no other members, it is deleted.

(6) After your account has been deleted, the following remain with others: copies of your recipes that members have saved, including the photo; the names of your recipes in polls, meal plans and shopping lists and the photos in polls (except after a block, § 8 (4)); items you added to shared shopping lists. Your votes and details such as "created by" or "added by" are kept without any reference to you. Details are in the Privacy Policy.

(7) You only receive push notifications if you enable them in the app. They inform you about polls, new members and new recipes in a list and mention list, recipe and display names. You can turn off each type individually in the app.

§ 10 Rules of conduct

(1) When using Pickeroni, it is prohibited

  1. a) to add content that violates the law, in particular content that is criminal, insulting, incites hatred, glorifies violence, is pornographic or harmful to minors;
  2. b) to infringe the rights of others, in particular copyrights, personality rights and the right to one's own image (§ 8 (5));
  3. c) to distribute advertising or spam;
  4. d) to circumvent free limits or usage limits by technical means;
  5. e) to use Pickeroni in an automated way, for example with scripts or bots, or to extract content automatically;
  6. f) to attack or disrupt Pickeroni, our servers or other users, for example through malware, overload or exploiting security vulnerabilities;
  7. g) to misuse invitations, for example to contact people unsolicited or to join a list without an invitation;
  8. h) to impersonate another person.

(2) Violations may lead to the measures under § 11 (3).

§ 11 Reports and moderation

(1) You can report recipes that others have shared in your lists in the app: in the recipe via "Report recipe". You choose a reason ("Inappropriate content", "Infringes copyright", "Spam or advertising" or "Other") and can write a comment of up to 1,000 characters.

(2) Everyone else, including people without an account, can report unlawful content by email to contact@pickeroni.com. So that we can review a report, please state:

  • which content is affected, as precisely as possible,
  • why you consider the content unlawful,
  • your name and email address (optional for reports concerning child sexual abuse material),
  • that your information is accurate and complete to the best of your knowledge.

(3) We review every report ourselves, carefully and objectively. We do not make automated decisions and do not use automated tools for moderation. Depending on the severity of a violation, we may:

  1. a) block a recipe: it is then no longer visible to anyone except you, is removed from all lists and can no longer be shared or saved. Polls, meal plans and shopping lists no longer show it with its name or photo; the photo copy in polls is deleted, votes already cast remain. You keep the recipe in your account;
  2. b) also block the copies that members have saved from this recipe, with the same effect (§ 8 (4));
  3. c) in the event of serious or repeated violations, suspend your account or terminate the contract for good cause (§ 15 (4)). As a rule, we will warn you first, unless the violation is so serious that this cannot reasonably be expected of us.

(4) We confirm receipt of your report and inform you of our decision, in each case by email. If we block content or an account, we inform the person concerned by email and give reasons: what we blocked, why, which rule we rely on, whether the decision was based on a report and what means of redress are available.

(5) If you disagree with a decision, write to us at contact@pickeroni.com; we will then review it again. You can also go to court.

(6) If there is a suspicion of a criminal offence that threatens the life or safety of persons, we inform the competent authorities (Article 18 of Regulation (EU) 2022/2065, "Digital Services Act").

§ 12 Availability, updates and defects

(1) We provide Pickeroni as required by this contract and the statutory requirements for digital products (section 327e BGB). We do not promise any particular availability. Pickeroni may be temporarily unavailable for maintenance, updates or in case of faults; we keep such interruptions as short as possible. Your rights in case of defects ((4)) remain unaffected.

(2) For as long as the contract exists, we provide you with the updates needed to keep Pickeroni in conformity with the contract, including security updates (section 327f BGB). You receive app updates via the App Store or Google Play.

(3) We may block older versions of the app, for example if they no longer work with our servers. The app then shows "Update required", and you can only continue to use Pickeroni after updating. If you do not install an update we have provided within a reasonable time, although we informed you about the update and the consequences, we are not liable for a defect that results solely from the missing update; this does not apply if the installation fails because of faulty instructions from us (section 327f (2) BGB).

(4) The statutory rules on digital products (sections 327 et seq. BGB) apply to defects. Please report defects to contact@pickeroni.com.

§ 13 Changes to Pickeroni

(1) Beyond what is necessary to keep Pickeroni in conformity with the contract (§ 12), we only change Pickeroni for a valid reason. Valid reasons are adapting to new technical environments, operating system versions or a sharp increase in the number of users, changed requirements from Apple or Google, changes in the law or case law, eliminating security risks and preventing abuse. A change does not cost you anything, and we inform you about it clearly and comprehensibly.

(2) If a change impairs your access to Pickeroni or your use of it more than insignificantly, we inform you by email in good time beforehand about the characteristics and timing of the change and about your right to end the contract. You can then end the contract free of charge within 30 days; the period begins when you receive the information or, if the change is made later, when the change is made. This does not apply if we offer to let you continue using Pickeroni without the change and at no extra cost.

(3) (1) and (2) also apply to the free limits (§ 5) and the usage limits (§ 6). If we lower them, your existing content is kept.

(4) We do not devalue a purchased unlock: for accounts with the unlock, we do not introduce free limits for features that already existed at the time of purchase, and we do not charge a further price for these features. § 6 (4) applies to the usage limits.

§ 14 Changes to these Terms

(1) We may change these Terms for the future, for example because of new features or changes in the law. An amended version only applies to you if you expressly agree to it. Your silence does not count as agreement.

(2) After a change, the app asks for your agreement the next time you start it or sign in. It links to the new version; what has changed is stated at its beginning under "What's new?". You can agree, sign out or delete your account. As long as you have not agreed, you cannot continue to use Pickeroni; until then, the previous version continues to apply to the contract.

(3) If you do not agree, you can terminate the contract at any time (§ 15 (2)), and we can terminate it with the notice period under § 15 (3). If you have bought the unlock, the compensation rule in § 15 (3) also applies in this case.

§ 15 Term and termination

(1) The contract runs for an indefinite period.

(2) You can terminate the contract at any time without notice by deleting your account:

  • in the app under Account › Delete account,
  • without the app at pickeroni.com/account/delete if your account has a password,
  • by email to contact@pickeroni.com, for example if you only sign in with Apple or Google. We then verify that the request comes from you by asking back at your account's email address, and delete the account within one month at the latest.

(3) We can terminate the contract with three months' notice in text form, for example by email, for instance if we discontinue Pickeroni. If you have bought the unlock, we will in this case refund the full purchase price you paid to Apple or Google for it on request; our notice of termination tells you how to request the refund.

(4) Either party can terminate the contract for good cause without notice (section 314 BGB). Good cause for us is in particular a serious violation of § 8 (5) or § 10, or a violation repeated despite a warning. A warning is not required if, because of the severity of the violation, we cannot reasonably be expected to continue the contract. We terminate in text form and give reasons (§ 11 (4)).

(5) When the contract ends, we delete your account together with your own recipes including photos, your memberships and your personal meal plans and shopping lists; what remains with others is set out in § 9 (5) and (6). We also delete the record of any purchase (§ 7 (5)). How long data then remains in backup copies is stated in the Privacy Policy.

§ 16 Liability

(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, for fraudulently concealed defects and to the extent that we have given a guarantee.

(2) In the case of slight negligence, we are only liable if we breach an essential contractual obligation. Essential obligations are those whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely – for example, that we do not lose your stored content and that we provide Pickeroni in a condition that conforms with the contract. Our liability is then limited to the damage that was typically foreseeable when the contract was concluded.

(3) Otherwise, we are not liable for damages or for reimbursement of futile expenses.

(4) (1) to (3) also apply to the liability of our legal representatives and vicarious agents.

(5) Your other statutory rights for defects in digital products (sections 327 et seq. BGB), such as cure or termination of the contract, remain unaffected.

(6) The following notes do not restrict (1) to (4): recipes in Pickeroni – including the "Recipes from Pickeroni" – are no substitute for nutritional or allergy advice and contain no allergen information. The automatic conversion of quantities and the timers in cooking mode are aids; check quantities and cooking times yourself when cooking. You are responsible for food safety when cooking, for example for cooking poultry, minced meat and eggs thoroughly.

(7) We regularly back up the data stored with us. There is currently no function for exporting your content; you can obtain information about your data as described in the Privacy Policy.

§ 17 Recipes from Pickeroni, app licence and open-source licences

(1) The "Recipes from Pickeroni" are our own editorial content. Their photos come from Unsplash and are used under the Unsplash License; the app names the photographers and the licence under Account › Legal › Image credits.

(2) If you save a Recipe from Pickeroni, you may use the copy privately in Pickeroni, edit it and share it with your lists.

(3) For as long as the contract exists, we grant you the simple (non-exclusive), non-transferable right to use the app for private purposes on your devices.

(4) Pickeroni contains open-source software. It is subject to the licences listed in the app under Account › Legal › Open-source licenses; for the respective software, these licences take precedence over the Terms.

§ 18 Additional terms for the iOS app

(1) This section also applies if you download Pickeroni from Apple's App Store. It implements Apple's requirements. It does not restrict your statutory rights, in particular for defects in digital products (sections 327 et seq. BGB).

(2) These Terms apply only between you and us, not between you and Apple. We, not Apple, are solely responsible for Pickeroni and its content.

(3) The right of use under § 17 (3) applies to the iOS app on Apple-branded devices that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions. Other accounts associated with your Apple Account may also use the app via Family Sharing or volume purchasing.

(4) We alone provide maintenance and support for Pickeroni, as set out in these Terms and as required by law. Apple has no obligation to do so.

(5) We alone are responsible for warranties (§ 12 (4), § 16 (5)). If the app fails to conform to a warranty, you may also notify Apple; Apple will then refund any purchase price you paid for the app. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. We alone are responsible for any other claims, losses, damages and costs attributable to such a failure.

(6) We, not Apple, are responsible for addressing any claims by you or third parties relating to the app or your possession or use of it, in particular product liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.

(7) If a third party claims that the app or your possession or use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.

(8) You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

(9) When using the app, you must comply with applicable third-party terms, for example those of your mobile or internet contract.

(10) Please direct any questions, complaints or claims regarding the app to us (contact details in § 1 (2)).

(11) Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your agreement to these Terms, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

§ 19 Data protection

How we handle your personal data is described in the Privacy Policy at pickeroni.com/privacy. It is not part of these Terms. By agreeing to these Terms, you do not give any consent under data protection law.

§ 20 Final provisions

(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If your habitual residence is in another member state of the European Union or in Iceland, Liechtenstein or Norway, you retain the protection of the mandatory consumer protection provisions of that state.

(2) We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

(3) You can make declarations under these Terms to us in text form, for example by email.
